Palestine has the right to sue ‘Israel’ at ICC: Saeb Sha’ath



An analyst says Palestine is absolutely entitled to sue Israel at the International Criminal Court (ICC) for the “war crimes, genocide, and major human rights violations” committed by the Zionist entity.

The comment comes as the United States has objected to the presence of a senior Palestinian official sitting behind a nameplate that read ‘State of Palestine’ at the United Nations Security Council.


Susan Rice, the US ambassador to the UN, expressed Washington’s disapproval of the latest move by Palestinians to capitalize on their upgraded UN status as Palestinian Authority Foreign Minister Riad al-Malki spoke at the Security Council on Wednesday.


It was the first Palestinian address to the Council since the UN General Assembly voted to upgrade the status of Palestine to non-member observer state on November 29, 2012.


Press TV has conducted an interview with Saeb Sha’ath, a political commentator in Belfast to further discuss the issue. What follows is a rough transcription of the interview.


Press TV: Sir welcome to the program. How do you view the comments by Susan Rice at the United Nations Security Council (UNSC) meeting? Some see it as a way to downplay Palestinians’ threats to turn to the [International Criminal Court] ICC to prosecute Israeli officials for their crimes. Do you see it in that light as well?


Sha’ath: Yeah, it is. The keyword here is the ICC since the Palestinians became eligible to join the ICC after the UN general assembly upgraded Palestine status; the world body in November upgraded Palestine from an observable entity for non-member state, which is legally considered a de facto recognition of independent Palestine state. That in its own allows the Palestinian Authority to join the International Criminal Court and file charges against Israel for war crimes, genocide, and major human rights violation, they committed.



First of all the Palestinian Authority have to join the ICC. They are obliged to join it and once they are a member they can take the Zionist entity for many many criminal investigations. That’s what scares the United States of America , the Zionist entity and behind it as well Europe.


They are applying in here tactics to just drag in the Palestinian entity, in the West Bank through financial pressures and that is for the negotiations with the Israelis. That’s all. So the Palestinians as well in the West Bank they’re using today’s announcement as a kind of pressure to join the negotiations.


The Palestinian authority did let down their own people after the recognition in the United Nations, the Palestinian people expected some major move to the ICC against Israel; at least to stop them from building the E1 area outside Jerusalem al-Quds, which will split the West Bank in two areas and totally annex Jerusalem al-Quds to the Zionist entity.

That will destroy any chance of establishing a Palestinian state through the two-state solution; the Palestinian authority and the international community as well understand that is against the Geneva conventions which forbids construction on occupied lands.


So there are many crimes [being committed] in here [that] the Palestinians can take the Zionist entity to the ICC for, the international community cannot do anything to protect Israel except pressurizing the Palestinians themselves not to go that far.
